What these terms cover
These terms apply to the MarketThing app at app.marketthing.ch and to this website at www.marketthing.ch. MarketThing is provided by Sophie Maier, a sole proprietorship in St. Gallen, Switzerland (“we”). By using the app or the website you accept these terms.
MarketThing is in development
MarketThing is not for sale yet. The app can currently only be used by invitation or with test access we grant, and it is free of charge for that time. Features change, may be removed and may not work as described. We give no guarantee that the app is available at any particular time or without interruption, and we may pause or end test access at any time. The prices on this website are planned prices, not an offer.
Accounts
There is no public sign-up: we create every account ourselves, or a workspace invites you. Keep your password and your second factor (the authenticator app) to yourself and safe, and tell us straight away if you think someone else has used your account. You are responsible for what happens in the app under your account, and in particular for the content you approve and publish.
Connected social accounts
A workspace can connect accounts on LinkedIn, Bluesky, Instagram, Facebook, TikTok and YouTube. You connect on the platform itself and grant access there; we never see your password for it. Other channels, such as Threads or X, are not connected: a person publishes there by hand. If we add a connection for them later, these terms apply to it in the same way.
By connecting an account, you authorise MarketThing to publish on it, on your behalf, the content a person in your workspace has approved, and to read what the app needs to show how that content performed. MarketThing publishes nothing that no one approved. You may only connect accounts you are entitled to use, and you remain bound by the terms and rules of each platform; MarketThing does not change what a platform allows.
You can disconnect an account at any time in the app. When you do, the app deletes its stored access tokens for that account and asks the platform to revoke them, where the platform offers a way to do so. Instagram and Facebook offer none; there, you remove MarketThing in your Meta settings, and the app tells you where. You can also withdraw MarketThing’s access in the platform’s own settings at any time.
Drafts written by Muse
Muse, the app’s assistant, drafts text and pictures with an AI model. Drafts can be wrong, incomplete, out of date or similar to existing material, and can contain claims that are not true. Nothing a draft says goes out without a person approving it. Read every draft before you approve it: the decision to publish, and responsibility for what is published, stay with you.
Your content
What you and your workspace put into the app — briefs, texts, pictures, plans — remains yours, and so do the drafts made for you. You grant us only the rights we need to store, process and show it in the app, to send it to the AI provider your workspace chose when you ask for drafts, and to publish it on the channels you instruct. We do not use it for anything else.
You confirm that you hold the rights to what you upload and publish, including the rights of people shown in pictures.
What you may not do
You may not use MarketThing to publish or store unlawful content; to send spam or run misleading campaigns; to infringe the copyright, trademarks, privacy or other rights of others; to break the rules of a connected platform; or to get around, probe or overload the app’s security, access controls or limits. We may suspend or end access where we have reason to believe one of these is happening.
Data protection
How we handle personal data is set out in the privacy policy at /privacy. The app stores its data in Zurich; some providers it relies on process data outside Switzerland, as the privacy policy explains.
Liability
MarketThing is provided free of charge, in development and as it is. To the extent Swiss law permits, we exclude liability for damage arising from its use, in particular for lost data, lost profit, content that was or was not published, interruptions, and the acts of connected platforms and AI providers. This does not limit liability for damage we cause intentionally or through gross negligence, or any other liability that cannot be excluded by law.
Ending use
You can stop using MarketThing at any time and ask us to delete your account by writing to [email protected]. We can end your access at any time, in particular when the test phase ends; where we can, we tell you in advance. What happens to your data then is described in the privacy policy.
Changes to these terms
We may change these terms, for instance when MarketThing goes on sale or the app gains a new connection. The version published here applies; its date is at the top. If a change affects you materially, we tell you by email before it takes effect.
Law and jurisdiction
These terms are governed by Swiss law, excluding its rules on conflict of laws. The place of jurisdiction is St. Gallen, Switzerland, unless mandatory law provides otherwise.
